Numetrics Time, copyright 1997 by Numetrics Corporation, is distributed as two separate editions, the EVALUATION EDITION and the REGISTERED EDITION.
The term EVALUATION EDITION identifies the product distribution containing the 30 day evaluation version of the product. The term EVALUATION COPY identifies an instance of the EVALUATION EDITION.
The term REGISTERED EDITION identifies the product distribution containing the purchased version of the product. The term REGISTERED COPY identifies an instance of the REGISTERED EDITION.
The term SOFTWARE PRODUCT identifies both EDITIONS of the Numetrics Time series.
No component part of the SOFTWARE PRODUCT may be distributed individually, disassembled, reverse engineered, or altered in any form. This includes all elements of the user interface, menus and dialogs, of the SOFTWARE PRODUCT.
WARRANTY AND LIABILITY
To the maximum extent permitted by applicable law, Numetrics expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.
To the maximum extent permitted by applicable law, in no event shall Numetrics or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this Numetrics product.
You may not rent or lease the SOFTWARE PRODUCT.
Without prejudice to any other rights, Numetrics may terminate this agreement if you fail to comply with the terms and conditions of this agreement. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
DISTRIBUTION
EVALUATION COPIES may be freely distributed by individual users for evaluation utilization.
EVALUATION COPIES may be uploaded to Bulletin Board Systems, FTP sites, Usenet newsgroups and any network sites providing its users with access to download it for evaluation purposes. Bulletin Board Systems should restrict downloading charges for the EVALUATION EDITION to flat rate connection fees.
EVALUATION COPIES may NOT be distributed in CD-ROM disks, diskettes or any other media, without express authorization of the author. Authorization for distribution may be obtained in the form of a specific Distribution License Agreement, signed by Numetrics.
EVALUATION COPIES may NOT be distributed with any software package, or be systematically recommended to users of any software system or service without express authorization of Numetrics. Authorization for distribution may be obtained in the form of a specific Distribution License Agreement, signed by Numetrics.
REGISTERED COPIES may only be distributed by Numetrics, or by distributors who have obtained a specific Distribution License Agreement, signed by Numetrics.
